01Who we are

This Privacy Policy explains how GWA Ventures, LLC, doing business as Axiome ("Axiome," "we," "us," or "our"), collects, uses, and shares information when you visit our website or use our services.

Axiome is a health and wellness brand. We are not a pharmacy, a medical practice, or a healthcare provider. We do not sell, prescribe, dispense, or distribute prescription medication. We provide a website through which you may request access to telehealth consultations and, where clinically appropriate, prescription products fulfilled by licensed third parties.

Our services are offered only within the United States, and only in the states listed on our website. We do not knowingly offer services to, or collect information from, individuals outside the United States.

02Who holds your health record

This is the most important section of this policy. Your medical information is not held by Axiome. It is held by the licensed clinical partner that provides your care.

When you complete a medical intake form, that information goes to Beluga Health, P.A., a Florida professional corporation and the licensed telehealth practice whose providers evaluate you and make prescribing decisions. Beluga Health is the HIPAA Covered Entity for your protected health information ("PHI"). Beluga Health owns your medical record. Axiome does not.

The technology platform that carries your intake to Beluga Health, stores your medical record, and processes payments is operated by FUSE Health Inc. Axiome and FUSE Health each act as Business Associates with respect to your PHI, under written business associate agreements. That means our access to your health information is limited by contract and by HIPAA to what is necessary to support your care and administer your account.

Beluga Health's own Notice of Privacy Practices governs how your PHI is used and disclosed for treatment, payment, and healthcare operations, and describes your rights under HIPAA — including your right to access, amend, and obtain an accounting of disclosures of your medical record. Prescriptions determined to be clinically appropriate are dispensed by licensed pharmacies. The current dispensing pharmacy is The Pharmacy Hub, which works with Beluga Health under its partnership with FUSE. The dispensing pharmacy receives the information it needs to fill and ship your prescription, including your name, shipping address, and the prescription itself, and handles that information under its own privacy obligations as a HIPAA-covered pharmacy. Axiome does not dispense medication and does not choose your pharmacy.

Health information you provide to our clinical partner

Your medical intake responses, clinical history, lab results, and any messages you exchange with a provider are submitted through our website to Beluga Health and the FUSE Health platform. As described in Section 02, that information is held by Beluga Health as the Covered Entity. Axiome receives only limited information about your order status — for example, that an order was approved, declined, or shipped — and does not receive your full medical record.

06Payment information

FUSE Health Inc. is the Merchant of Record for patient transactions, and card payments are processed by Stripe. Your full payment card number is submitted directly to the payment processor. Axiome does not receive or store full card numbers. We receive limited information such as the last four digits, card brand, and whether a charge succeeded.

Because FUSE Health is the Merchant of Record, the descriptor that appears on your card or bank statement may differ from "Axiome." [[CONFIRM exact statement descriptor with FUSE and state it here — LegitScript and card networks both expect this]]

07Your privacy rights

Depending on where you live, you may have the right to request access to the personal information we hold about you, to correct it, to delete it, to obtain a portable copy, and to opt out of certain uses. You also have the right not to be discriminated against for exercising these rights.

Requests about your medical record must go to Beluga Health, which holds it as the Covered Entity. We will help direct your request to the right place. Requests about your Axiome account, marketing preferences, or order history can be sent to us using the contact details in Section 13.

We will verify your identity before acting on a request. If we deny a request, we will tell you why and how to appeal.

Marketing opt-out. You can unsubscribe from marketing email using the link in any marketing message, or by contacting us. You will continue to receive transactional messages about your orders and account.

08Consumer health data

Several states — including Washington, Nevada, and Connecticut — have laws that give additional protections to consumer health data collected outside of HIPAA. Where those laws apply to information we hold, we collect and use that information only to provide the services you have requested, we obtain your consent where required before collecting or sharing it, and we do not sell it.

Residents of Washington State may exercise rights under the My Health My Data Act, including the right to withdraw consent and to have consumer health data deleted, by contacting us at the address in Section 13.

09Security

We use administrative, technical, and physical safeguards designed to protect the information we hold, including encryption in transit, access controls, and vendor diligence. Our platform partner maintains the safeguards required of a HIPAA business associate. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

If a breach affecting your information occurs, we will notify you and the appropriate authorities as required by law.

10Retention

We keep account and order information for as long as your account is active and afterward as needed to comply with our legal, tax, and recordkeeping obligations, resolve disputes, and enforce our agreements. Medical records are retained by Beluga Health in accordance with the retention periods required by applicable state medical practice laws, not by Axiome.

11Children

Our services are intended solely for adults 18 years of age or older. We do not knowingly collect personal information from anyone under 18, and we do not direct any marketing to minors. If we learn that we have collected information from someone under 18, we will delete it.

12Changes

We may update this policy from time to time. When we do, we will revise the "Last updated" date above. If the changes are material, we will provide additional notice, such as an email or a notice on our website, before they take effect.
